General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) govern the contractual relationship between Fahrschule Aschmann and its learner drivers for all training services offered at all locations.
1. Formation of the training contract
The training contract is concluded by written registration and confirmation by the driving school. Upon conclusion of the contract, these GTC are deemed accepted.
The contract entitles the learner driver to participate in the theoretical and practical training services in accordance with the chosen driving licence class.
2. Training services
The driving school provides training in accordance with the statutory provisions of the Driving Instructors Act (Fahrlehrergesetz, FahrlG) and the Driving Learners Training Ordinance (Fahrschüler-Ausbildungsordnung, FahrschAusbO).
- Theory lessons in accordance with the statutory mandatory curriculum
- Practical basic and performance levels
- Special trips (out-of-town, motorway, night)
- Practical test preparation
- Driving simulator training (if booked)
The scope of practical training depends on the individual learning progress and the assessment of the responsible driving instructors.
3. Learner driver obligations
- punctual attendance at theory and practical lessons
- carrying a valid ID to every driving lesson
- following the driving instructor’s instructions
- appropriate clothing and sturdy footwear
- not attending under the influence of alcohol, drugs or driving-impairing medication
In the event of a breach of safety instructions, the learner driver may be excluded from the lesson.
4. Driving school obligations
- proper training in accordance with FahrlG and FahrschAusbO
- teaching all content required by law
- use of trained and certified driving instructors
- providing safe, functional training vehicles
5. Scheduling and cancellation of driving lessons
Driving lessons are arranged individually. Cancellations must be made at least 2 business days in advance.
In the event of short-notice cancellations or failure to attend, the driving school may charge a cancellation fee in the amount of the agreed driving lesson, provided that no replacement appointment can be arranged.
6. Exam admission and exam fees
Admission to the theory and practical exam is granted as soon as the required knowledge and skills are available.
Fees for exams (TÜV) must be paid separately and are not part of these GTC.
7. Contract Term and Reactivation
The contract ends upon passing the exam or upon final failure of the exam, or by termination in text form (e.g. by email; Section 126b German Civil Code (BGB)). Termination solely due to inactivity does not take place.
If the training is inactive for 12 months without any activity (no theory lessons, no driving lessons, no exams), the training is considered dormant. For resumption/reactivation, a processing and reactivation fee in the amount of 50% of the agreed basic fee is due; this must be paid before the training continues.
There is no automatic contract extension; the contract continues until it ends in accordance with the provisions above.
8. Termination of the training contract
The learner driver may terminate the contract at any time in writing. Services already provided must be paid in full.
A flat administrative fee of 50 euros is charged for processing a contract termination.
The driving school may terminate if:
- the learner driver is repeatedly absent without excuse
- payments are not made despite a reminder
- appointments already agreed are repeatedly missed without notice
- safety instructions are seriously breached
- training is significantly disrupted by misconduct
9. Vouchers and discounts
Vouchers or discounts are valid until registration for the exam. Cash payment is excluded.
9a. Price adjustment
The agreed prices apply to services that become due within 6 months after the contract is concluded. If services become due only after more than 6 months after the contract is concluded, the driving school may adjust the prices for services not yet provided, provided that cost factors (e.g., operating, vehicle, personnel or energy costs) have demonstrably changed. Services already booked or already provided will not be increased.
10. Right of withdrawal for online registration
For online registrations, there is a statutory 14-day right of withdrawal pursuant to §§ 312g, 355 BGB.
If services are fully provided within the withdrawal period, the right of withdrawal expires pursuant to § 356 para. 4 BGB, provided that express consent was given.
11. Data protection
Our privacy policy applies to the processing of personal data at {{page:datenschutz}}.
12. Final provisions
German law applies. Place of jurisdiction is the seat of the driving school, insofar as legally permissible.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
